The wPolityce.pl portal revealed the background to the changes in the trial panel in the case of the prosecutor’s complaint about the non-arrest of MP Marcin Romanowski. The Chairwoman of the National Council of the Judiciary, Dagmara Pawełczyk-Woicka, and Zbigniew Ziobro, leader of Sovereign Poland and former Minister of Justice, reacted to the publication on our website.
The wPolityce.pl portal has concluded that the decision to exclude Judge Przemysław Dziwański was taken by Judge Krzysztof Chmielewski while considering Judge Aleksandra Rusin-Batko’s request to exclude herself from this case. The President of the National Council of the Judiciary announces the initiation of explanatory proceedings against Judge Chmielewski in connection with this situation.

Announcement of start of explanatory process
The @wPolityce_pl portal reports that: “the decision to remove Judge P. Dziwański was made by Judge Krzysztof Chmielewski” when considering the request to remove Judge A. Rusin-Batko, to which he was appointed. If the media reports are confirmed, I will request during the @KRS_RP proceedings to initiate explanatory proceedings against the judge. Such actions cannot be treated as an error in the interpretation of the law.

The court has already examined the grounds for the exclusion of Judge Dziwański and assessed them negatively. This closed the case. Judge K. Chmielewski was appointed to exclude Judge Rusin-Batko. He had no right to exclude Judge Dziwański. If he had done so, he would have violated the (USP) Act, which determines how cases are assigned to judges, regardless of the violation of the Code of Criminal Procedure.

A court established by law is not a court formed by a decision of a judge made without any procedure or contrary to the law. The actions of Judge Krzysztof Chmielewski (if confirmed) will raise further doubts, and the decision made by the Warsaw Court of Appeal, regardless of what the decision is, may be questioned!
