Can a publicly accessible database contain data on people who were convicted when there were no regulations governing such sanctions? The Constitutional Court will answer this question in a month.
The provision allowing the inclusion of data on perpetrators of sexual crimes in the public register has been in effect since October 1, 2017 (Law on Combating the Threat of Sexual Crimes, namely the 2024 Law Journal, number 560, as amended). In this list, commonly called the “pedophile register”, you can find the names and surnames of people convicted of certain sexual acts committed before that date. According to one of the courts, this is unconstitutional. The Constitutional Court will consider the issue on October 24. The first hearing of the case is scheduled for today.
