The Ministry explains that work is currently being finalised on the draft law amending the Local Taxes and Fees Act, in a version that takes into account the comments submitted following public consultations and during a two-day consultation conference with the participation of representatives of ministries, municipalities and businesspeople.

As mentioned, the purpose of the amendments currently being processed is to specify the provisions governing the taxation of buildings and structures with property tax, while maintaining status quo tax.

Tax on photovoltaic energy?

The ministry indicates that, on the one hand, this means that taxpayers will not pay a higher tax and, on the other hand, municipal budgets will receive tax revenues at the current level. This also applies to the taxation of farms and photovoltaic installations.which both currently and in light of the proposed solutions will not be taxed in full, but only on their construction elements (supporting structures). Photovoltaic parks are not currently or in the proposed solutions listed as subjects of real estate tax.

“During the ongoing legislative process, the Ministry of Finance has repeatedly informed that in order to avoid any doubts regarding the scope of taxation of photovoltaic parks, the issue of taxation of only their construction parts will be clearly regulated in the provisions of the Law, which was well received by the community of entrepreneurs operating in the solar energy sector. At no stage of the legislative work did the Ministry of Finance consider taxing air conditioning units, generators and photovoltaic panels.and the dissemination of this type of false information only serves to cause anxiety among businesspeople and citizens,” reads the ministry’s statement.

By 2024, the power of installed photovoltaic panels increased by an impressive 40%. In the database “Operation of photovoltaic installations in Poland 2024” compiled by the Renewable Energy Institute, there were 4,870 photovoltaic installations above 50 kW in our country, of which 262 were parks above 0.5 MW.

The largest number of photovoltaic parks was recorded in the Warmian-Masurian Voivodeship (48), the Greater Poland Voivodeship (34) and the Lublin Voivodeship (21).
