Special prosecutor Jack Smith has announced a new charge against Donald Trump for his attempts to remain in power despite losing the election. The new reduced charge takes into account the Supreme Court’s July 1 decision granting Trump partial immunity.

In a new indictment approved by a new grand jury, investigators still accuse Trump of the same charges related to his actions to overturn the election results and remain in power, but limit their allegations to Trump’s private actions.

The following items were missing from the original indictment: mention of the then-president’s pressure on the Justice Department to support Trump’s narrative of a “stolen” election, despite a lack of evidence. In a precedent-setting ruling in early July, the Supreme Court ruled that the president’s official actions — those related to his basic duties as head of state — are protected by “absolute” immunity. The court concluded that this also included the president’s contacts with members of his administration.

In the new indictment – nine pages shorter than the original – Investigators are focusing on the activities of Trump and his associates in a private capacity.

The new indictment was filed 70 days before the election, that is, 10 days before the deadline, ruling out the possibility of filing charges against political candidates. Still, it is virtually impossible for the process to begin before the November presidential election.

Trump himself reacted to the prosecutor’s action on his social networking site TRUTH Social, retweeting a post suggesting that if he wins the election he will fire the prosecutor and drop the charges against himself.
