Following the arrest this Wednesday, 18, of the Chief of the Civil Police of Alagoas, Daniel Mayer, accused of obstructing the investigation into the murder of businessman Kléber Malaquias, the Popular Jury of the three people involved in the crime, scheduled for Thursday, 19, was postponed by the 8th Criminal Court of the Capital. The decision was taken by Judge José Braga Neto, president of the 8th Criminal Court, at the request of the Public Ministry of the State of Alagoas (MPAL), through the 3rd Prosecutor’s Office of Rio Largo, who understood that it was necessary to postpone the Jury Trial due to the recent emergence of new evidence.
“Therefore, I understand that the trial must be postponed, in accordance with the principle of broad defense, considering the emergence of new documents that were prematurely included in the case file, so as not to harm the defense and the guilty party. The Prosecutor’s Office. Therefore, I grant what the Prosecutor’s Office requested,” the judge said firmly.
Now the trial of Fredson José dos Santos, José Mário de Lima Silva and Edinaldo Estevão de Lima is expected to take place on February 17, 2025 at the Barro Duro Forum.
According to the MPE/AL, the complaint shows that the delegate Daniel Mayer, who worked at the Judicial Police Directorate of Region 1, in Maceió, introduced false evidence created together with other parties involved in order to change the truth of the facts, aiming to mislead the jury, the judge and the public itself. These facts were demonstrated after a legally valid discovery, which proves the exchange of favors for fraudulent purposes.
The Public Ministry, through prosecutors Lidia Malta and Kleber Valadares and the Special Action Group for Combating Organized Crime (Gaeco), also obtained revealing conversations, also through judicial authorization: “They show a conspiracy led by the police authorities to bring false accusations against a person who had already been murdered, all aimed at protecting the real perpetrators of the crime, in possible collusion with those under investigation, dealing a real blow to Justice, which was not expected by any public authority, especially the police chief, explains the prosecutor.
For MPAL, knowing these facts is in the social interest because this type of action is considered “extremely reprehensible and serious, carried out by an authority whose mission is to protect and combat crime and not to act as an enabler”.
Evidence comes after jury adjourns
“Unfortunately, during the trial of the murder of Kleber Malaquias, which was conducted before a Jury Court, it became clear, through the actions of the defendants’ defense, that these venerable institutions were exploited by criminals for illegitimate purposes. The arrest of this high-ranking delegation of the Civil Police of Alagoas came after the preventive detention and denunciation of a civil police officer, also involved in the crime, who represented a key link in identifying those who ordered the murder”, report Lídia Malta and Kleber Valadares.
“It is important for the public to have access to the truth, especially given the proliferation of conflicting information in the media and social networks. This confusion is understandable, given the complexity and volume of the process, as well as the unprecedented and immoral nature of the recently discovered acts, making it difficult to understand the progress of the investigation and the process,” they stressed.
The prosecutor also highlighted that the criminal acts committed by some individuals do not determine the value and importance of institutions in Alagoas society, nor should they generate distrust in the routine functioning of these institutions. On the contrary, for them, these institutions have civil servants who uphold the principles of honesty, legality and ethics, and whoever deviates from them, committing an unlawful act, must be punished accordingly, always in accordance with the law.
Finally, MPAL added that new measures will be taken to identify the participation of other people involved in the crimes of which the delegation is accused, as the investigation deepens, with the aim of individualizing the behavior of other accomplices. “We also want to show solidarity with professionals who act ethically and who every day reaffirm their commitment to constitutional principles and to community life. We express our solidarity especially to all the victims, direct and indirect, who have the fundamental and non-negotiable right to justice, because life is the highest and irreplaceable good”, added Lídia Malta and Kleber Valadares.
Understand the case
The businessman, who was known to have made several complaints against Alagoas politicians, was shot dead on July 15, 2020, inside the Buchada bar, located on Avenida Teotônio Vilela, Mata do Rolo, in the municipality of Rio Largo.
Based on the initial survey conducted by PM, Malaquias who was celebrating his birthday arrived at the scene accompanied by three friends and went to the bathroom. Two men were already at the scene and one of them followed the victim who was cornered in the bathroom and killed with three shots, one of which was in the head.
Kleber Malaquias has already stated that he is under oath to death. He is the author of several complaints against politicians and members of the Alagoas Judiciary. One of these complaints, which was brought to the National Judicial Council, resulted in an investigation of a judge from Alagoas.
Three of the six defendants were due to go on trial this Thursday, the 19th, but due to a change in the case, the trial was rescheduled for February 2025.
