The Warsaw Regional Prosecutor’s Office is investigating Orlen SA’s notification regarding material damage caused to the company in the total amount of PLN 393,000. PLN 600. According to its spokesman, prosecutor Mateusz Martyniuk, an indictment has been announced against Zbigniew L., former director of the Control and Security Office of Orlen SA
Allegation of abuse of power
Zbigniew L. was charged with abuse of power conferred, in that, as an authorised person, in his capacity as Director of the Control and Security Office of Orlen SA, he approved the payment of remuneration to the entity providing detective services to Orlen SA, even though he knew that these services were not provided in accordance with the contracts, which caused significant material damage to the company.

The Public Prosecutor’s Office, based on the evidence collected in the process in the form of documentation and witness statements, determined that Orlen SA entered into two contracts in 2021 with an entity providing detective services, the purpose of which was to identify and document unfair competition activities against Orlen SA.
Meanwhile, the entity only provided the company with materials relating to the actions of politicians opposing the then government, which had no economic significance for the company.

Zbigniew L. did not confess
Zbigniew L. did not plead guilty to the charge brought against him and refused to provide any explanation. The prosecutor did not apply any preventive measures against the suspect.

Radio Zet reported the details of the detective services that were to be hired by Orlen at the end of June. According to these reports, two detective companies founded by former high-ranking secret service officers were to deal with the matter. Orlen was to pay almost PLN 3 million for this; according to the broadcaster, this is confirmed by the invoices found.
Tusk and Obajtek spoke
In early March, Prime Minister Donald Tusk said that “President Obajtek signed, among others, “a mission for a detective whose task was, as it was called in the letter, to identify unfair competition activities in relation to PKN Orlen.”
According to the head of government, these were Civic Platform MPs – Marcin Kierwiński and Jan Grabiec – and Andrzej Halicki, a PO MEP. According to informants interviewed by Radio ZET at the time, the detective’s area of interest included MP Władysław Kosiniak-Kamysz (PSL), Senator Stanisław Gawłowski (PO) and MP Marek Biernacki (formerly PSL-Koalicja Polska, currently Trzecia Droga).
The former president of Orlen commented on the prime minister’s words on social media.
