The last few years have been filled with many favourable rulings from the Court of Justice of the EU, which have led to a lasting change in the thinking of Polish judges. Initially, they were very sceptical about the idea of invalidating loan agreements and effectively freeing borrowers from having to pay back to the bank anything other than the capital they were lent. Today, rulings in favour of borrowers in francs are the majority.
However, the situation is completely different in the case of those who took out a loan in PLN, granted on the basis of the WIBOR index. Despite the arguments put forward by some law firms specializing in supporting borrowers, the courts are not willing to question WIBOR as a non-transparent indicator. So far, no judgments in favor of banks have been made in this type of case.
