Donald Tusk’s words about the Supreme Court have had a wide impact. Professor Andrzej Zoll’s reaction

“The Supreme Court raises no doubts”

Prof. Andrzej Zoll referred to the Prime Minister’s words, stating that although Tusk’s statement was harsh, Supreme Court as an institution, there is no doubt because it is based on the constitution and laws. However, the functioning of the Supreme Court is seriously hampered by the changes introduced in the last eight years.

Chambers incorrectly named in the Supreme Court

Zoll highlighted that the creation of two Chambers in the Supreme Court was not based on the provisions of the Constitution, and the judges sitting there were not lawfully appointed. These chambers also do not meet the standards of courts under European law, which further complicates the functioning of the Polish judicial system.

Difficult reconstruction of democracy

According to Zoll, during the government PIS Poland was moving away from democratic standards towards authoritarianism, which led to a weakening of the separation of powers, especially in the area of the judiciary. The current government, which wants to restore democracy, should focus on removing the obstacles that were introduced in previous years.

Rebuilding the Rule of Law

The professor emphasized that reconstruction rule of law and the return to the full functioning of the separation of powers requires repairing the damage caused by the previous authorities. This is crucial to restoring the proper role of the judiciary in a democratic state governed by the rule of law.
