Respecting the peace is crucial for harmonious coexistence in a community. Article 51 of the Petty Crimes Code: whoever, by noise, shouting or alarm, disturbs the peace, public order during the day or night, or causes a scandal in a public place, will be subject to a fine, imprisonment or restriction of liberty. It is also important to know whether the person who disturbed the peace and tranquility was under the influence of drugs or alcohol.
Civil law on disturbance of daily peace
Phenomenon disturbing the peace and quiet of the day is also subject to regulation civil law. Article 144 says about prohibition of immission. For example, in a shared housing complex, each owner must refrain from activities that may interfere with the use of their apartments by their neighbors. The interference may be direct, such as intentionally leaving waste on a neighbor’s property (protection of private property – art. 140 CC), or indirect, i.e. sound, smell, liquid. Indirect emission is also divided into material and immaterial. Owners can protect themselves against such emissions by invoking: art. 23 and 24 of the Civil Codethat is, in the way of protecting personal rights and art. 222 of the Civil Code in connection with art. 144 CC.
