According to the Polish Press Agency, the National Prosecutor’s Office has filed charges against Marcin Wosi. Charges of exceeding his powers and failure to fulfill his obligations – consisting in the transfer of an amount of PLN 25 million from the Justice Fund for the purchase of Pegasus software to the CBA – were filed on Tuesday against the former deputy minister of justice.
Pegasus and accusations against Michał Woś: failure to fulfill duties and excess of powers
As we read in the statement of the National Prosecutor’s Office, the failure to fulfill the duties of which the politician is accused consisted in “concluding on September 29, 2017 with the Head of the Central Anti-Corruption Bureau an agreement on the transfer of funds from the Justice Fund to the Central Anti-Corruption Bureau in the amount of PLN 25,000,0000 for the purchase of a special service, knowing that this special service did not meet the conditions to receive such financial support from the Justice Fund. As indicated in the notice, “the activities of the CBA are financed by the State Budget and could not be financed by the State special fund.”
In turn, the allegation of excess of powers concerned the order to pay the above-mentioned amount by the Justice Fund to the CBA in execution of the contract concluded with the Board. Thus, Woś allegedly acted “to the detriment of the public interest, causing large-scale material damage to the assets of the State Treasury and to the detriment of private interests, resulting in limited availability of the fund’s resources to other entities”.
The crime Michał Wos is accused of is punishable by imprisonment for up to 10 years.
