After the court agrees to pre-trial detention, the Prosecutor’s Office will work on issuing an arrest warrant for the former head of the RARS, Michał K. As I understand it, the case is of great importance and the Prosecutor’s Office will act as quickly as possible – said the head of the Ministry of Justice, Prosecutor General Adam Bodnar.
On Tuesday, the spokesman for the National Prosecutor’s Office, Prosecutor Przemysław Nowak, announced that during the investigation conducted by the Katowice Prosecutor’s Office into irregularities in the Government Agency for Strategic Reserves (RARS), evidence was obtained that allows the preparation of indictments. participation in an organized criminal group and excess of powers and failure to fulfill duties to obtain financial benefits in relation to two other persons – Michał K. and Paweł Sz.
On Thursday, the Katowice-Wschód District Court in Katowice accepted the prosecutor’s request against Michał K. and imposed a preventive measure on him in the form of pre-trial detention for 90 days from the date of arrest. This will allow us to begin searching for him with an arrest warrant.. However, the court did not accept the request against Paweł Sz., concluding that the fear of fraud in his case was not great enough to require temporary detention.
Minister Adam Bodnar was asked on TVN24 whether agreeing to the temporary arrest and announcing an arrest warrant against the former RARS chief “is not an exaggeration”.
Which is not an exaggeration, since the decision was taken by the court at the request of the Public Prosecutor’s Office. (…) Simply it was not possible to determine the place of stay of Mr. Michał K. on the territory of the Republic of Polandthat’s where these motions came from and the court agreed with them. This means that the commission of the act was substantiated. This is very important – these allegations were taken into account by the court – replied the Minister of Justice.
When asked about press reports that Michał K. was supposedly staying in the internationally unrecognized Northern Cyprus and Paweł Sz. in Spain, Bodnar replied that he could not refer to such media reports.
As he added, does not know when the Public Prosecutor’s Office will issue an arrest warrant for Michał K. Now the Public Prosecutor’s Office will work on it; I don’t know how long it will take and whether it will be today or Monday. From what I understand, the case is very important and the Public Prosecutor’s Office will deal with it as soon as possible. – said the head of the Ministry of Justice.
Bodnar also recalled that against Paweł Sz. the court did not rule on pre-trial detention. In his opinion, this may indicate a greater willingness of the suspect to cooperate, which – as he noted – is also indicated by his defense lawyer’s request for the so-called safe conduct, i.e. a document issued by the court guaranteeing that the defendant will remain free until the end of the trial.
